Terms & Services of Whitehousecreatives
Services: Whitehousecreatives provides advertising and marketing services, including but not limited to branding, graphic design, digital marketing, social media management, content creation, and campaign development. The specific services and deliverables will be outlined in the project scope or agreement.
Client Responsibilities: a) Provide accurate and complete information: You are responsible for providing accurate, complete, and up-to-date information necessary for the execution of the services.
b) Timely feedback and approvals: You agree to provide timely feedback, approvals, and decisions required for the progress of the project.
c) Intellectual property rights: You represent and warrant that you have the necessary rights and permissions for the content provided to us. You grant us a non-exclusive, royalty-free license to use such content for the purpose of providing the services.
- Payments: a) Fees and Payment Terms: The fees for our services will be as mutually agreed upon in the project scope or agreement. Payment terms, including due dates and payment methods, will also be specified in the project scope or agreement.
b) Late Payments: In the event of late payments, we may suspend services or charge interest on the overdue amount at a rate specified in the agreement or as permitted by law.
- Confidentiality: a) Both parties agree to treat any non-public information disclosed during the course of the services as confidential and shall not disclose, use, or reproduce such information without the other party’s prior written consent, except as required by law.
b) This obligation of confidentiality shall survive the termination of this Agreement.
- Intellectual Property: a) Ownership: Any intellectual property rights arising from the services provided by Whitehousecreatives, including but not limited to designs, concepts, or creative work, shall belong to Whitehousecreatives, unless otherwise agreed upon in writing.
b) License: Upon full payment of fees, we grant you a non-exclusive, non-transferable license to use the deliverables solely for the agreed-upon purpose.
- Limitation of Liability: a) We shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the services, including but not limited to loss of profits, revenue, or data.
b) Our total liability under this Agreement shall not exceed the fees paid by you for the services.
Termination: Either party may terminate this Agreement upon written notice if the other party materially breaches any provision and fails to remedy such breach within a reasonable time. Termination shall not relieve the parties of any obligations incurred before termination.
Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in [insert relevant city or jurisdiction].
